Chief Judge Matsui Hidetaka stated in his reasons for the ruling that “political decisions, with limited financial resources, are permissible to give priority to one’s own citizens over foreign residents,” following the Supreme Court precedent that exempts foreign residents from the application of the Public Assistance Act. He pointed out that “there is no basis for the Livelihood Protection Act to be applied to a certain range of foreigners.” In the appeal court, the plaintiffs argued that “protection should be granted to at least certain foreigners, such as those who have resident registration,” but the ruling rejected this, stating that “the decision on whether to make foreigners eligible for public assistance is left to the broad discretion of the legislature.” “Very sad news,” Johnson said in English at a press conference after the ruling, as his visa status was changed due to serious illness, and he was barred from working and denied welfare benefits. “We will continue to fight to the end,” he said, indicating his intention to appeal. Johnson came to Japan in 2015 and suffered from severe kidney failure in 2019. His residence status was changed to “specific activities” for medical treatment and he was prohibited from working, so he applied for welfare benefits to the city of Chiba in 2021, but his application was rejected. The reason they lost is because they applied for welfare under the Public Assistance Act in the first place. Foreigners should apply for something like extra-legal public assistance based on a notification from the Minister of Health, Labor and Welfare.
