Oita The Oita District Court sentenced a defendant to prison for assaulting a male acquaintance who had hugged his partner at a drinking party, resulting in his death, calling the assault “grossly excessive.”
On the 25th, the Oita District Court handed down a verdict in a lay judge trial on an unemployed defendant (41) charged with assault resulting in death for assaulting a male acquaintance and causing his death. Presiding Judge Yasutaka Karashima sentenced the defendant to six years in prison (the prosecution had called for eight years). According to the verdict, the defendant, who had attended a drinking party with a woman he was dating, hugged a male drinking buddy (then aged 40) on the street in Kitahama, Beppu City in the early hours of December 3rd last year, pulled him to the ground, kicked him in the stomach, and caused him to bleed to death that same day. While presiding judge Karashima acknowledged that the act was excessive self-defense as it was done to protect the woman, he said, “It was so excessive that it resulted in fatal injuries.”
>>5 The word “kick” may also mean “to step on” in police slang and the internal organs ruptured, causing massive bleeding in the abdominal cavity (no bleeding outside the body), a death similar to that of Shinzo Abe.
It’s not to protect her. It’s just jealousy. I mean, jealousy is an instinct even for monkeys. If you’re going to get involved with someone else’s woman, you need to be prepared for the consequences.
He’s 41 and has a criminal record. Even if he gets parole, his life after that will be very hard. He’ll probably be sued in civil court too, even if he has assets.
