We asked lawyer Tomoe Terabayashi. ● Instructing only women to wear makeup is gender discrimination First of all, in general terms, explicitly instructing only women to wear makeup in a work rule constitutes gender discrimination, and such a rule would be invalid as it violates the principle of good faith (Article 1 of the Civil Code). Also, as in this case, it can be said that forcing a company or superior to prohibit a specific woman from wearing makeup and to wear makeup constitutes sexual harassment. According to the national definition, sexual harassment refers to (1) sexual verbal or physical actions in the workplace that make others uncomfortable, and (2) sexual verbal or physical actions outside the workplace that make other employees uncomfortable, and sexual verbal or physical actions include “verbal or physical actions based on the belief that roles should be divided according to gender.” Forcing a specific woman to wear makeup and a company or superior to prohibit her from wearing makeup can be said to be “verbal or physical actions based on the belief that roles should be divided according to gender” or something equivalent. I don’t think or say anything about people who you can tell just by looking at them that they’re wearing natural makeup. Please don’t suddenly go without makeup. It’s physically scary.
Am I the only one who thinks people look like monsters when they wear makeup? I feel scared when I see their eyes and unnaturally white skin that looks like they’ve been painted on.
Nowadays, even men wear makeup, so it’s outdated if both men and women don’t wear it if they want to. Same goes for shoes. Forcing women to wear pumps and stockings is an old-fashioned bad custom.
