The first oral argument in a lawsuit filed by Japan national soccer team player Junya Ito (French first division/Stade de Reims) and others seeking approximately 200 million yen in damages for damages resulting from “false” criminal complaints filed by two women who claim they were “forced to engage in sexual acts” was held on November 26th at the Tokyo District Court (Judge Chieko Shimizu, presiding). On this day, both the plaintiff, Ito, and the defendant, the woman, made statements. Ito’s side claims that “we have suffered damage as a result of the false accusations made by the women and the series of reports.” The woman asked for the claim to be dismissed, arguing that “he made her drink large amounts of alcohol, and then in the early hours of the morning, while she was completely drunk, he had sex with her without using contraception,” and that “this is a SLAPP lawsuit filed to make an example of her.” On this day, the two women held their first press conference at the Judicial Press Club in Kasumigaseki, Tokyo. One of the women said, “I only have fragmentary memories, but there’s no doubt that we had sex,” reiterating that the sexual assaults were real. ● Both sides filed criminal charges, both were “not indicted” In January of this year, the women filed criminal charges for quasi-forced sexual intercourse, alleging that they were sexually assaulted by Ito and others at a hotel in Osaka City in June 2023. This was reported by the weekly magazine Shincho. Ito’s side claimed the allegations were unfounded and filed a criminal complaint against the woman for filing false accusations. Both parties were not indicted, but in the civil lawsuit filed by Ito’s side, he “is claiming that not only the criminal charges but also the series of actions, including the reporting, were illegal,” according to his attorney, Todoroki Hironobu. After the oral arguments, press conferences were held by both the plaintiffs and the defendants. Attorney Hirotaro Kato, who represents Ito, said he believes the case does not constitute a “SLAPP lawsuit” as suggested by the woman’s side.
